The purpose of these General Terms and Conditions is to define how you, as a customer/user, may benefit from our Services and to define how we can benefit from you using our Services.

These General Terms and Conditions apply to all who want to use the services on this website. Our full General Terms and Conditions can be consulted in English in this hereunder. By using this Website, you agree that you have read and accepted our full terms and conditions. By purchasing a ticket, you accept and agree to these terms and conditions. Please read them carefully.

Definitions

  • General Terms and Conditions: these General Terms and Conditions.
  • Client or Applicant: the natural person of at least sixteen (18) years of age or legal person who has accessed the Services or has entered into an agreement with VRBUS or its agency or to whom VRBUS or its agency has issued a quotation or has made an offer.
  • Agreement: the agreement concluded between VRBUS and the Client regarding the Services.
  • Service or Services: providing passenger transportation services via GROUPTRANSPORT.COM.AU and VRBUS’s Website.

  • The General Terms and Conditions apply to all offers of VRBUS and to all current and future commercial relations, agreements, and other legal relationships between the Parties. Applicability of the Client’s general terms and conditions is explicitly excluded.
  • By using or accessing our Services, or by posting or downloading any content from or through the Services, the Client/user acknowledges, agrees, and indicates that it has read and understands and agrees to be bound by these General Terms and Conditions.
  • Using our service:
  • When using the Services provided by VRBUS on the Website, the Client shall apply on VRBUS’s Website. The Client shall fill in the information on the Website and upload certain personal information including name and contact details of the Client that is required in order to avail the Services provided by VRBUS.
  • The Applicant must approve the terms and conditions before submitting the application.
  • VRBUS reserves the right at all times to disclose any information as VRBUS deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in VRBUS’s sole discretion.
  • You agree that VRBUS has no responsibility or liability for the deletion, corruption, or failure to provide any Services or other content maintained or transmitted by any VRBUS Services. You acknowledge that VRBUS reserves the right to log off accounts that are inactive for an extended period without notice.
  • If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

3b. Using our Services:

  • Road Passenger Transportation.

Day Trips, Tour Packages, and Charter Services.

The services will be paid for in full when the services are ordered.

  • These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.
  • We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
  • Passengers must be present and ready to board at least 15 minutes prior to departure time. Boarding and seating are on a first-come, first-served basis. Passengers must present a valid ticket and government-issued photo identification to board the bus. Passengers who are not present at the scheduled departure time may forfeit their seat.
  • Passengers may bring up to two pieces of baggage, not exceeding a total weight of 50 pounds, and one carry-on item. All baggage must be properly labelled with the passenger’s name and contact information. VRBUS runs a lost property program and will do everything within our limits to ensure that any properties left behind in the bus will be secured and returned safely. VRBUS is not responsible for lost, stolen, or damaged baggage. VRBUS reserves the right to refuse any baggage that is deemed unsafe or unsuitable for transportation.
  • Passengers must comply with all applicable laws, regulations, and VRBUS policies while on the bus. Smoking, drinking alcohol, and the use of illegal drugs are strictly prohibited on the bus. Passengers may not interfere with the safe operation of the bus or the comfort of other passengers. Passengers who engage in disruptive or threatening behaviour may be removed from the bus.
  • A passenger who is 15 years of age or older and travelling with an infant must buy a ticket for themselves and pay 50% of the regular adult rate for a ticket for that infant. A complimentary ticket will be provided for a second Infant if the same individual wants to accompany both Infants. Additional Infants travelling with the same person will be charged 50% of the regular adult ticket.
  • Modification of these General Terms and Conditions:

VRBUS reserves the right to change the terms, conditions, and notices, including but not limited to the charges associated with the use of the VRBUS’s Services. You are responsible for regularly reviewing these General Terms and Conditions and additional terms posted on websites. Your continued use of VRBUS Services constitutes your agreement with VRBUS to all such terms, conditions, and notices.

  • No Unlawful or prohibited use:

 As a condition of your use of the VRBUS Services, you will not use the VRBUS Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the VRBUS Services in any manner that could damage, disable, overburden, or impair any VRBUS Services (or the network(s) connected to any VRBUS Services) or interfere with any other party’s use and enjoyment of any VRBUS Services. You may not attempt to gain unauthorized access to any VRBUS Services, other accounts, computer systems or networks connected to any VRBUS Services. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the VRBUS Services.

  • Termination:

 VRBUS reserves the right, in its sole discretion, to terminate your access to any or all VRBUS Services and the related services or any portion thereof at any time, without notice.
Any kind of account termination does not entitle any of VRBUS’s Clients to reimbursement of any kind for the months already paid for by any user.
VRBUS shall have no obligation to maintain any content or to forward any unread or unsent messages to you or any third party.

  • Intellectual Property Rights:

 All intellectual property rights of this Website and of what’s contained in this Website are owned by VRBUS.

  • Liability:

VRBUS shall make reasonable efforts to ensure 24/7 availability of our services, but shall not be liable for any unavailability due to technical constraints and/or bugs, and maintenance operations, which shall not give rise to any right to any refund whatsoever.

VRBUS is not liable for any loss, damage, or injury arising from the transportation of passengers or their luggage, except as required by law. VRBUS is not responsible for delays or cancellations due to circumstances beyond its control, including but not limited to weather, traffic, or mechanical issues. Passengers are responsible for their own safety and security while on the bus and should take appropriate precautions. VRBUS is not responsible for any lost, stolen, or damaged personal property.

  • Payments: We accept the following payment methods on our Site:
  • Credit Card.
  • PayPal; and
  • Debit.

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument. If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

  1. Shipping and Delivery: Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and public holidays. You will not be charged for the delivery of the goods you purchase on our Site. You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person because of you providing us with inaccurate or incomplete information.
  2. Refunds:

Refunds for Goods and Services: Refunds are processed in accordance with Australian Consumer Law. Due to the cost of providing our services to you, any changes to booking must be made at least 7 days prior to scheduled booking for a complete refund.

Consumer Protection Law: Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
  2. Indemnity: Except where prohibited by law, by using this Site you indemnify and hold harmless VRBUS PTY LTD and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

  1. Legal Disclaimer:

Our Website and Services should only be used for legitimate and lawful purposes respective to the region of the world you are using our services from and to the region of the world the person you are sending the message is from.
We will do our best to detect any unlawful activity by the users of our Website and Services. If we do detect such unlawful activity, we will delete the user account concerned and we will comply with any request from law officials to disclose information to them.
Any trademark mentioned on this website is the property of its respective owners. These trademarks are only used for the purpose of describing how our service works.

  1. General:

This agreement is governed by the laws of the Australian Capital Territory. You hereby irrevocably consent to the exclusive jurisdiction and venue of the courts in Australian Capital Territory in all disputes arising out of or relating to the use of the VRBUS Services. You agree that no joint venture, partnership, employment, or agency relationship exists between you and VRBUS as a result of this agreement or use of the VRBUS Services. You agree to indemnify and hold VRBUS, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim, demand, or damage, including reasonable legal fees on a solicitor-client basis, asserted by any third party due to or arising out of your use of or conduct on the VRBUS Services.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. VRBUS will not be liable to you for any breach of these General Terms and Conditions, which arise because of any circumstances that VRBUS cannot reasonably be expected to control. Unless otherwise specified herein, this agreement constitutes the entire agreement between the Client and VRBUS with respect to the VRBUS Services.

  1. Amendment:

VRBUS has the right to amend the terms at any time, as long as it is not prohibited by law. It also indicates that the terms in effect at the time of the ticket purchase and travel apply, but VRBUS may apply changes retroactively if it is operationally necessary and does not have a material negative impact on the customer.

Additionally, the terms specify that no VRBUS representatives, including employees and ticketing agents, have the authority to modify or alter any provision of the terms unless authorized in writing by a VRBUS’S corporate officer or authorized designee. This means that any changes or modifications to the terms must be approved by a higher-level authority within the company and cannot be done by individual representatives or employees.

  1. Tickets:

Tickets must be purchased prior to boarding the bus. All tickets are non-refundable and non-transferable unless otherwise specified. Tickets may be purchased online on our website, at a VRBUS terminal, or through an authorized agent. VRBUS reserves the right to change schedules, routes, and fares without notice.

It is the responsibility of both the ticket purchaser and passenger to ensure that the passenger’s first and last name and travel information are accurately reflected on the ticket. Using a ticket by anyone other than the named passenger will result in the ticket being void and may be confiscated. Passengers without valid tickets may be charged a fee. If a passenger does not comply with the terms and conditions, VRBUS may cancel the remainder of the itinerary or booking, seize any unused portion of the ticket, refuse to allow the passenger to board or check baggage, and charge the passenger the remaining value of the ticket. Children over the age of two must have a ticket, while children under two may travel for free if they sit on an adult’s lap.

  1. Documentation Required at the time of Boarding:

To board the bus, every passenger must show a valid printed or electronic ticket. This ticket grants transportation only between the points of origin and destination specified on the ticketed schedule, at the reserved date and time. During boarding, passengers who are 16 years old or older may be asked by Bus Operator or bus station personnel to show a valid Government-issued photo ID, such as a current Driver’s License, Passport, Permanent Resident Card, or U.S. Military ID card, that contains their name, date of birth, and photograph. Passengers who are 16 years old or older must present the requested ID to board the bus. On international routes, every passenger, regardless of age, may be required to show any Government-issued ID needed for entry into another country and/or other required travel documents, in addition to their ticket and ID. Passengers are solely responsible for having all necessary documents, and neither VRBUS nor the Bus Operator is liable for any costs or damages incurred due to their failure to do so, including return transportation. For more details, refer to the International Routes section.

  • Operations of VRBUS:

Bus Operators will make reasonable efforts to transport passengers and their baggage to their destination according to the schedule, but the details on the ticket or published trip schedules, such as departure and arrival times, bus types, and stops, are not guaranteed and are subject to change. VRBUS and Bus Operators may substitute different Bus Operators or buses, rent buses and/or drivers, alter schedules, delay or cancel trips, and change or skip stops if it’s necessary for operations and safety, and at their sole discretion. VRBUS and Bus Operators are only liable for such changes as specified in the Refunds section of these Terms.

If a bus becomes unserviceable during the trip, VRBUS and/or Bus Operators will try their best to provide affected passengers with a replacement bus or transportation to a suitable waiting point from where they can continue their journey.

VRBUS and Bus Operators are not responsible for any cancellations, delays, changes in the schedule, buses, or routing, or for failing to run a bus trip on time. Additionally, they are not responsible for any costs, expenses, damages, or losses incurred by passengers directly or indirectly because of such cancellations, delays, changes, or failure to run the bus trip on time.

VRBUS will make every effort to inform passengers of delays, cancellations, and similar issues as soon as possible. However, this may not be possible if some Bus Operators lack the technical capability to notify VRBUS promptly, and thus, VRBUS may not be able to alert passengers.

  • No Discrimination

We do not discriminate based on race, gender, color, religion, national origin, or any other protected characteristic with regard to reservations, purchases, and seating.

  • No Smoking:

Smoking or the use of any smokeless tobacco products, including e-cigarettes, is strictly forbidden on or within fifteen (15) feet of the bus. However, some schedules may provide comfort stops during which passengers can take a short break and smoke in designated areas that are authorized.

  • Video and Audio Monitoring Used in Buses.

For security purposes, video and audio recording equipment may be present at bus stations, buses, and boarding locations. These recordings may be viewed by authorized personnel or third-party service providers responsible for security or recording services. If requested by law enforcement or other government officials, recordings may also be made available to them. Furthermore, recordings may be shared with any third party deemed necessary by the Recording Controllers. By accepting these Terms or entering an area with such equipment, you are consenting to any recordings and their use.

  • Consent to Use of Personal Data.

By booking a ticket for transportation, purchasing other services, or participating in any program or service provided by VRBUS and/or Bus Operators, you are authorizing them and their authorized agents to collect, process, retain, use and transfer any personal data you provide for various purposes. These purposes may include, but are not limited to, making a reservation, purchasing a ticket, obtaining ancillary services, accounting, billing and auditing, checking credit or other payment mechanisms, customer relations, sales and marketing, statistical analysis, developing and tailoring current and future services, complying with applicable laws and regulations, providing data to third parties or governmental or law enforcement agencies for security or health measures, and protecting the legal rights of VRBUS, Bus Operators, and/or their affiliates. The personal data collected may be transferred to third parties, including but not limited to subcontractors, agents, affiliates, marketing partners, other carriers, and government agencies. VRBUS and/or Bus Operators may use and transfer personal data in their discretion, and your consent to this is implied by your acceptance of these terms or participation in their programs or services.

  • Acceptable Behavior:

As a passenger on a bus offering virtual reality experiences, it is important to follow certain guidelines to ensure a safe and enjoyable experience for everyone. The following code of conduct policy outlines the expectations for all passengers:

  1. Respect other passengers: It is important to respect the personal space and virtual experiences of other passengers. Please refrain from touching or interfering with other passengers’ equipment or VR experiences.
  2. Use headphones: To prevent disruption to other passengers, please use headphones while enjoying your virtual reality experience. This will also help you fully immerse yourself in your own experience.
  3. Follow instructions from the driver: The driver of the bus is responsible for your safety and the safety of others. Please follow any instructions given by the driver regarding the use of virtual reality equipment, seating arrangements, or other safety procedures.
  4. Stay seated: To prevent accidents or injuries, please remain seated while the bus is in motion. Do not stand or move around the bus while wearing VR equipment.
  5. Be mindful of motion sickness: Virtual reality can cause motion sickness in some individuals. If you begin to feel sick, please remove your VR equipment and inform the driver.
  6. Do not disturb the driver: The driver needs to concentrate on safely operating the bus. Please do not disturb or distract the driver while the bus is in motion.
  7. No smoking, vaping, or drinking: Smoking, vaping, and drinking are not permitted on the bus. Please refrain from these activities for the duration of the ride.
  8. Do not share VR equipment: Each passenger has been provided with their own VR equipment. Please do not share equipment with others, as this can lead to unsanitary conditions and the potential for damage.
  9. Be mindful of battery life: The VR equipment has a limited battery life. Please be mindful of your usage and conserve battery power as much as possible.
  10. Report any issues: If you encounter any issues with your VR equipment or notice any safety concerns, please inform the driver immediately.
  11. Assistance Animals and Travel Assistance:

Passengers must inform VRBUS if they will be travelling with an assistance animal, specifying the kind of animal and the specifics of the certification from a recognized training organization.

  1. Certified assistance animals are allowed to travel for free while travelling with their human companions as long as they don’t endanger public health or interfere with the safe running of our services.
  2. Keep pets leashed or in a carrier: All pets must be either leashed or in a carrier at all times. This helps prevent the pet from wandering around the bus or interfering with other passengers.
  3. Clean up after your pet: If your pet makes a mess, it is your responsibility to clean it up immediately. Please bring cleaning supplies and dispose of waste properly.
  4. Sit in designated pet-friendly areas: A separate seat will be set aside for the assistance animal, pending availability. The passenger must select another service that has enough seats available if two seats together are not available.
  5. Be mindful of allergies: Some passengers may be allergic to pets or have respiratory issues that can be aggravated by pet dander. Please be mindful of this and sit away from these passengers if possible.
  6. Do not feed pets on the bus: Feeding pets on the bus is not allowed, as this can create a mess and be disruptive to other passengers.
  7. Be prepared for emergencies: The assistance animal must be prepared for travel and confined properly the whole time. Travelling passengers must have their own absorbent mats. If your pet has any medical issues or requires medication, please bring any necessary supplies with you. Be prepared to handle any emergencies that may arise.
